The Bath Pros Limited Warranty
The Bath Pros (the “Company”) provides this Limited Warranty to customers for the bathroom remodeling services performed at their property in McKinney/Celina, Texas, and surrounding areas. We stand behind the quality of our workmanship and materials, offering a 10-year warranty on our Wedi waterproofing system and a 1-year warranty on plumbing and electrical work, subject to the terms, conditions, and exclusions below. This warranty is fully transferable to new homeowners.
This Limited Warranty gives you specific legal rights, and you may also have other rights that vary by state.
⸻
1. Warranty Coverage
Waterproofing (Wedi System) – 10 Years
The Bath Pros warrants that all Wedi waterproofing materials we install—including shower pans, backer boards, seals, and related components—will remain 100% waterproof for ten (10) years from the date of project completion.
If a leak or waterproofing failure occurs within 10 years due to defective installation by The Bath Pros or a defect in the Wedi materials, The Bath Pros will repair or replace the affected area at no cost to you.
Plumbing & Electrical – 1 Year
The Bath Pros warrants that all plumbing and electrical work performed as part of your bathroom remodel will be free from defects in workmanship for one (1) year from the project’s completion. All such work is carried out by licensed plumbers and electricians in compliance with Texas law and local building codes.
If a leak, faulty wiring connection, or other covered issue arises within one year due to improper installation by The Bath Pros, we will repair the issue at no charge.
Warranty Start Date & Transferability
The warranty periods above begin on the date your bathroom project is completed. This warranty is transferable to a new homeowner if you sell your home. The unexpired portion of the warranty will transfer to the next owner. The new homeowner must notify The Bath Pros in writing of the transfer.
2. Exclusions – What This Warranty Does NOT Cover
While we stand by our work, this Limited Warranty only covers defects in The Bath Pros’ own workmanship or materials. It does not cover damage or problems caused by factors outside of our control or unrelated to our workmanship, including:
• Damage from Freezing: Leaks or burst pipes caused by freezing temperatures are not covered. Protecting plumbing from freezing is the homeowner’s responsibility.
• House Shifting & Structural Movement: Any damage, cracking, or issues caused by the settling, shifting, or movement of the building’s foundation or structure is not covered. This includes cracked tiles, grout separation, or caulk failure due to foundation movement.
• Indirect or Incidental Damages: The Bath Pros is not liable for secondary damages such as:
• Damage to other parts of your home, flooring, furniture, or personal belongings.
• Loss of use of your bathroom.
• Costs of temporary accommodations or rental expenses.
• Any other consequential or incidental losses.
• Third-Party Work Voids Warranty:
• If any repair, modification, or work is performed on the warranted portions of the project by anyone other than The Bath Pros, the warranty for that portion is immediately void.
• The Bath Pros will not cover any costs to “fix” work modified by others.
• If another contractor or homeowner attempts to adjust, remove, or modify any plumbing, electrical, or waterproofing installed by The Bath Pros, the warranty is void for that portion of the work.
• Back Charges for Third-Party Work Are Not Allowed:
• The Bath Pros will not accept or reimburse any “back charges” for work performed by another contractor to modify, repair, or “correct” our work.
• If a warranty issue arises, The Bath Pros must be given the opportunity to inspect and correct the issue first.
• If you hire another company to fix an issue and attempt to bill The Bath Pros, we will not pay for their charges.
• Normal Wear & Tear: Gradual changes such as grout discoloration, caulk shrinkage, or minor settling of materials over time are not covered.
• Improper Maintenance, Neglect, or Misuse: Any damage caused by lack of maintenance, misuse, improper cleaning products, or homeowner neglect is not covered.
• Acts of God & Natural Disasters: Damage from flooding, storms, fires, earthquakes, lightning, or vandalism is not covered.
• Manufacturer Warranties: Certain products (such as plumbing fixtures, tile, or electrical components) may be covered under the manufacturer’s separate warranty. The Bath Pros is not responsible for manufacturer defects but will assist in processing a manufacturer claim if applicable.
3. Making a Warranty Claim
To make a claim under this warranty, you must follow these procedures:
1. Proof of Purchase:
• You must provide proof that The Bath Pros performed the work (such as your contract, invoice, or a copy of this warranty).
2. Written Notice:
• You must notify The Bath Pros in writing within 30 days of discovering the issue.
• Your written notice should include:
• Your name, address, and contact information.
• A description of the issue and the date you first noticed the problem.
3. Inspection & Warranty Service:
• Once we receive your claim, The Bath Pros will schedule an inspection at a mutually convenient time.
• Do not attempt to repair the issue yourself or hire another contractor before our inspection—this may void the warranty.
• If the issue is covered, we will repair or replace the affected work at no cost.
4. If the Issue Is Not Covered:
• If the problem falls under an exclusion, we will notify you in writing.
• If requested, we can provide an estimate for a non-warranty repair at your expense.
4. Limitations of Liability
• This warranty is the only express warranty given by The Bath Pros and replaces all other warranties, express or implied.
• To the fullest extent permitted by law, The Bath Pros disclaims all implied warranties, including merchantability and fitness for a particular purpose.
• Limitation of Liability: The Bath Pros is not liable for incidental, indirect, special, or consequential damages. Our maximum liability is limited to the original contract price of the work performed.
5. Governing Law
This Limited Warranty is governed by the laws of the State of Texas. Any disputes arising from or related to this warranty must be resolved in a Texas court.
